Compliant with EU Consumer Rights Directive and GDPR

By using SpamKiller services, you fully accept these Terms of Service. Please read them carefully before proceeding.

1. Definitions

  • Provider / We: Cavallini.NET, VAT IT02438610392, Via Madonna, 10 - 48123 Ravenna (RA) - Italy
  • Customer / You: The individual or legal entity using SpamKiller services
  • Service: The SpamKiller SaaS platform for automatic spam detection via API
  • Plan / Subscription: The monthly credit package selected by the Customer (Free, Basic, Plus, Professional, Enterprise)
  • Credits: Unit of measure for available API validations
  • API: Application Programming Interface for integrating the Service

2. Subject of the Agreement

This agreement governs the provision of the SaaS service called "SpamKiller", which allows you to:

  • Analyze forms, comments, messages, and user-generated content via REST API
  • Automatically detect spam content using artificial intelligence (Google Vertex AI - Gemini)
  • Receive a spam score (spam_score), confidence level (confidence), and recommendations
  • Access analytics dashboard and statistics

3. Acceptance of Terms

Use of the Service implies full acceptance of these Terms of Service.

Acceptance occurs through:

  • Registration on spamkiller.io
  • Creating a project and generating an API key
  • Purchasing credits or subscribing to a plan

If you disagree with any clause, do not proceed with using the Service.

4. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the spam detection API Service under the following conditions:

4.1 Permitted Uses

  • Integrate the API into your websites, applications, or systems
  • Protect contact forms, registrations, and comments from spam
  • Use the Service for legitimate commercial purposes

4.2 Prohibited Uses

The following are expressly prohibited:

  • Reverse engineering, decompiling, or extracting the source code
  • Reselling, redistributing, or sublicensing the Service without written authorization
  • Using the Service for illegal or harmful activities
  • Attempting to bypass usage limits or security measures
  • Intentionally overloading the infrastructure (DoS, DDoS)
  • Sending content that violates third-party rights (copyright, privacy)
  • Using the API to collect personal data without GDPR consent

5. Plans and API Usage Limits

The Service is available in different pricing plans:

5.1 Exceeding Limits

If you exceed your monthly credit limit:

  • Subsequent API requests will return a 429 Too Many Requests error
  • Service will automatically resume on the 1st day of the following month
  • You can purchase additional credits or upgrade your plan at any time

6. Payment Methods and Invoicing

6.1 Payment Methods

Payments are processed through Stripe Inc. (PCI-DSS compliant processor). We accept:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • SEPA Direct Debit (for European customers)

6.2 Invoicing

For EU customers:

  • Consumers (without VAT number): Invoice with applicable VAT
  • EU Businesses (with valid VIES VAT): Invoice without VAT (reverse charge)
  • Non-EU: Invoice without VAT (outside VAT scope)

6.3 Automatic Renewal

Monthly plans renew automatically each month. You can disable automatic renewal by accessing your account settings.

6.4 Payment Delays

In case of non-payment:

  • We will send 2 reminders via email (at +3 and +7 days)
  • After 10 days, the account will be suspended
  • After 30 days, we reserve the right to delete the account and data

7. Right of Withdrawal (Consumers)

Right of Withdrawal for EU Consumers (EU Consumer Rights Directive 2011/83/EU)

If you are a consumer (an individual acting for non-professional purposes), you have the right to withdraw from the contract within 14 days of the purchase date, without giving any reason.

7.1 How to Exercise Withdrawal

To exercise your right of withdrawal, send us an explicit statement via:

Your communication should include:

  • Your name
  • Account email address
  • Purchase date
  • Description of service purchased
  • Statement of withdrawal

7.2 Exceptions to Withdrawal Right

According to the EU Consumer Rights Directive, the right of withdrawal does NOT apply if:

  • You have fully used the purchased credits before withdrawal
  • You have expressly requested immediate service delivery (waiving withdrawal)

7.3 Refund

In case of valid withdrawal, we will refund the full amount paid within 14 days of receiving your communication, using the same payment method used for the purchase, unless otherwise agreed.

8. Service Availability (SLA)

8.1 Guaranteed Uptime

We commit to guarantee:

  • Free/Basic Plan: 99% monthly uptime
  • Plus/Professional Plan: 99.5% monthly uptime
  • Enterprise Plan: 99.9% monthly uptime + priority support

8.2 Scheduled Maintenance

We may perform scheduled maintenance with at least 48 hours email notice. Maintenance is not counted in uptime calculations.

8.3 Force Majeure

We are not responsible for interruptions due to force majeure, including (but not limited to): DDoS attacks, third-party infrastructure failures (Google Cloud, Hetzner), natural disasters, pandemics.

9. Intellectual Property

All intellectual property rights related to the Service (code, algorithms, documentation, logo, brand) are and remain the exclusive property of Cavallini.NET.

Any reproduction, distribution, or modification without written authorization is prohibited.

10. Limitation of Liability

Limitation of Liability

To the extent permitted by applicable law:

10.1 Indirect Damages

We are not liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service, including (but not limited to):

  • Loss of profits or revenue
  • Loss or corruption of data
  • Cost of substitute services
  • Reputational damage

10.2 Maximum Liability

Our maximum liability is limited to the amount paid by the Customer in the 12 months preceding the damaging event.

10.3 Spam Detection Accuracy

The Service uses artificial intelligence which, while highly accurate (>95%), does not guarantee perfect detection of all spam content. The Customer:

  • Remains responsible for final content moderation
  • Must implement additional controls for critical content
  • Accepts that false positives and false negatives may occur

11. Privacy and Data Protection

The processing of personal data is governed by our Privacy Policy, compliant with GDPR (EU Regulation 2016/679).

Summary of main data processing:

  • Account data: name, email, hashed password
  • Validation data: content submitted via API (retained 90 days)
  • Billing data: company name, VAT number, address (retained 10 years for legal fiscal requirements)

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time.

In case of substantial changes:

  • We will send email notification at least 30 days before effective date
  • You have the right to withdraw from the contract without penalty if you do not accept the new terms
  • The updated version will always be available on this page

13. Contract Termination

13.1 Termination by Customer

You may terminate the contract at any time:

Note: Account deletion results in permanent loss of all data (projects, validations, statistics).

13.2 Termination by Us

We reserve the right to suspend or terminate access to the Service, without notice, in case of:

  • Violation of these Terms of Service
  • Fraudulent or abusive use of the Service
  • Non-payment exceeding 30 days
  • Activities harmful to other users or infrastructure

14. Governing Law and Jurisdiction

14.1 Governing Law

This contract is governed by Italian law.

14.2 Jurisdiction

For disputes arising from this contract:

  • B2B (businesses): Exclusive jurisdiction of Ravenna, Italy
  • B2C (consumers): Jurisdiction of consumer's place of residence, in accordance with EU Consumer Rights

15. Alternative Dispute Resolution (ADR/ODR)

For consumers: Before taking legal action, you may attempt mediation through:

  • Your local consumer mediation service

By registering and using the Service, you declare that you:

  • Have read and fully understood these Terms of Service
  • Unconditionally accept all clauses contained herein
  • Are of legal age and legally capable of entering into contracts
  • If acting on behalf of a company, have the necessary authority to bind the company
